Does the upcoming SECR compliance deadline affect you?

The deadline for businesses to complete and submit their Streamlined Energy and Carbon Reporting (SECR) compliance is approaching fast. In fact, many large companies only have until 30th September 2021 to submit their figures. But the truth is, of the estimated 12,000 UK businesses SECR affects, many still don’t know or realise they must comply.

Does my business have to submit SECR compliance?

SECR compliance only affects “large” businesses.

So, if your business is a:

  • Limited Liability Partnership (LLP)
  • Quoted company (a company whose shares are bought or sold on the stock exchange)

Or a large unquoted company that fulfils two of the following three requirements:

  • Over 250 employees
  • An annual turnover of over £36 million
  • An annual balance sheet totalling over £18 million

And your financial year runs between January and December; you must submit SECR compliance submissions by 30th September 2021.

What do I need to disclose?

If your company qualifies for SECR submission, you need to disclose:

  • Your energy use and greenhouse gas (GHG) emissions and energy use for the reporting period (financial year)
  • One intensity ratio
  • A written explanation of any energy efficiency actions undertaken during the reporting period
  • The method used to calculate the submitted information

What happens if I miss the SECR compliance deadline?

If you feel you’re going to miss the SECR compliance deadline due to issues relating to COVID-19, you can apply for a 2-month extension, giving you until 30th November 2021 to complete your submission.

But for everybody else, the 30th September deadline is set in stone – but what are the consequences of missing this date?

Well, at the time of writing, failure to submit SECR will not result in a fine for your business. However, other energy schemes, like ESOS, have hit companies with penalties of up to £50k. And although not submitting feels low-risk, should a large number of businesses fail to do so, it’s likely fines will be brought in.

And the reason for this has been explained by a spokesperson for the Department for Business, Energy and Industrial Strategy (BEIS), who said:

We don’t see penalties as a key driver for action.

While this might seem controversial, it’s hoped that business owners’ social and moral conscience and the challenges of cutting energy emissions to reduce global warming will be enough to spur them into doing the right thing.
